A judge has told a 26 year old man who failed to engage with the Probation service, despite being given a number of opportunities to do so, that he left her with no option but to impose a custodial sentence.
Cian Kearney with an address care of the Simon Community, Barrack Street, Dundalk was before Dundalk District Court last Wednesday accused of six offences, including theft.
The Defence solicitor told the court her client had no excuse to offer for missing his first appointment, after his case had previously been adjourned to enable him to engage with the Probation Service.
She added that he had showed up an hour earlier for the second one, as he had to collect a child from creche.
The goods that were stolen amounted to €318 and the solicitor said that a cheque for €200 was on its way to her office.
However, Judge McKiernan said she had made it clear to Mr. Kearney that he must engage and noted the report before her said he continues to present with no motivation to engage with the Probation Service and he was not deemed suitable to perform community service.
The judge added she had put the matter back a few times and he point blank refused to engage.
Judge McKiernan said "You've left me with no other option.
“Community service would have kept him busy but he wouldn't do it. People are out of pocket".
The judge noted the charges before her included four for theft, and imposed a four month sentence for the theft of a North Face gilet and jacket worth €250 from JD Sports, Marshes Shopping Centre.
The rest of the charges were marked 'taken into consideration'.
