Man (46) who gave a garda a black eye is jailed for possession of a knife in Dundalk

A man who claimed he had fled because there was a bench warrant for his arrest, when he struggled with a garda who suffered a black eye, has been jailed for 14 months at Dundalk Circuit Court.

A 46 year old man who claimed he had fled because there was a bench warrant for his arrest, when he struggled with a garda who suffered a black eye, has been jailed for 14 months at Dundalk Circuit Court.

Darren McElliogett with an address at College Manor, Hoey's Lane Dundalk was sentenced for possession of a knife and obstruction of a peace officer arising out of the incident on the Castletown Road, Dundalk on September 19th 2022.

Gardai were on patrol in the Castleross estate when they saw the defendant and a woman, who seemed to take evasive action on seeing them.

Darren McElligott seemed nervous when they approached him and ran.

He discarded a knife under a car at a nearby petrol station and in the course of a struggle, struck the garda.

He claimed that he had fled, because there was a bench warrant for his arrest.

The defendant had 87 previous convictions, 11 from the Circuit Court.

Judge Dara Hayes said it had a significant impact on the officer, whose confidence while on duty, has been shaken and he suffered from severe headaches and struggled to sleep for some time after the incident and still suffers from flashbacks.

He noted Darren McElligott has indicated his remorse, and had a lengthy history of poly substance misuse.

The judge imposed concurrent sentences totalling 23 months and suspended the final nine months on the defendant entering a good behaviour bond and placing himself under the supervision of the Probation Service for 12 months post release.
