Sold alcohol to underage girl

A shopkeeper who was prosecuted after a member of staff sold alcohol to an underage girl, avoided a conviction at Dundalk district court after paying €2,000 to the court poor box.

At the request of the Defence the money is to go to the Tidy Towns Committee in Dromiskin.

The court heard last Wednesday the teenager had bought a bottle of wine for €e9.99 from Mulligan’s in Dromiskin on the 18th of February last, in a test-purchase monitored by a garda sergeant.

The court was told when the member of staff involved was questioned afterwards he said he knew the girl and thought she was over 18. The Defence solicitor said the business has been there since the 1930s and the worker – who was a temporary employee, had made an honest mistake.

He asked the court not to record a conviction and said his client was in funds for €2,000.

He added the only quirk was that the defendant was asking the court to direct that the money goes to the Dromiskin Tidy Towns Committee so it would benefit the community where the shop is.

Judge Flann Brennan agreed and applied the Probation Act, but he added “That’s the only time that will happen”.
