in stolen council truck
Two men who admitted being passengers in a truck which had been stolen from a group of local council workers an hour before they were arrested, were given two year suspended sentences at Dundalk Circuit Court last week.
The court heard Paddy McDonagh (47) of The Anchorage, Bettystown and Thomas McDonagh (26) of Tara Lawns Coolock and Eden Court, Birr, County Offaly, were arrested on the M1 motorway at Oldbridge, Drogheda on the seventh of July last year.
The court heard on the afternoon in question five men were working for Dundalk Town Council at Marshes Upper when they were approached by three men around 3.30pm.
A “physical encounter” ensued during which an unsuccessful attempt was made to take the key to the council lorry, but the men returned and following a struggle, one got into the cab and drove off before stopping a short distance away where the two accused got in.
The truck was later spotted by a garda who was travelling between Dundalk and Drogheda.
After their arrest, Patrick McDonagh told gardai he was drunk and did not remember anything after leaving a pub, while Thomas McDonagh denied being involved in the Marshes Upper incident and claimed he was only getting a lift after visiting his sister.
Both Defence counsel argued it was an opportunistic crime, rather than anything more sinister.
The two accused entered bonds to be of good behaviour for two years.
