Judge tells jury to find Dundalk man not guilty in stabbing case

A 60-year-old man accused of stabbing of a man who produced a hatchet during a row with the defendant’s son, was found not guilty at Dundalk Circuit Court last week by direction of the trial judge.

Gerry McGahon with an address at Slieve Foy Park, Muirhevnamor, Dundalk had denied assault
causing harm and producing a knife at Crescent One,
Muirhevnamor, on the 30th of April 2011.

Following legal argument by the Defence at the end of the State’s case on Tuesday Judge Leonie Reynolds directed the not guilty verdict.

She explained to the jurors that from the outset the complainant had given evidence that went beyond what he said to Gardai.

She added he had also admitted consuming alcohol and drugs on the night, being involved in earlier altercations and had said that things “were fuzzy on the night”.

Judge Reynolds said the Prosecution’s case rested on the evidence of the complainant and she was satisfied that he could not be relied upon and for that reason she was directing the not guilty verdict.
