Bail condititions breached
A man accused of stealing heating oil from the Louth GAA Centre of Excellence in Darver, breached the terms of his bail when he spent Christmas with his father in Tralee, Dundalk district court heard last week.
The Defence barrister for Mark McCourt told the court that her client had made the mistake of not informing his solicitor of his change of address or seeking the permission of the court.
The 22 year old who is charged with stealing €1,200 worth of heating oil on the sixth of December last was granted bail at Drogheda district court the next day on condition that he stay at his sister’s home at St. Nicholas’ Avenue in Dundalk.
A garda told the court last Wednesday that the accused stayed there until the 22nd of December, but wasn’t there when his colleague called on Christmas Eve or on two further occasions, when he himself called to the house.
The garda added the accused – who had a signing on bail condition, had last signed on at Dundalk Garda Station on December 22nd and he was applying for a remand in custody.
The Defence barrister said her client had been arrested on foot of the bench warrant in Tralee and explained that his father had collected him and brought him there on December 23rd as he and the accused’s sister decided Mark McCourt should leave Dundalk and live with his Dad. She said it was in those circumstances that he had breached the bail conditions.Judge Flann Brennan refused the bail application and remanded the accused in custody for a week.
