Ardee beef farmer waiting on cheque
DESPITE having agreed previously to pay expenses to a former Ardee based Libertas candidate, it was alleged last week that Declan Ganley had not in fact made any payments.
A court had previously ordered Mr Ganley to pay Raymond O’Malley, a beef and cereal farmer from Ardee, expenses following his unsuccessful European Election tilt in 2009.
Mr O’Malley, who failed to get elected, sued Mr Ganley in the Circuit Civil Court for €35,366. He claimed Mr Ganley had agreed to pay his expenses if he became a Libertas party candidate.
It had been agreed between the parties that the settlement figure would be paid in two payments between now and the end of February together with an agreed sum towards Mr O’Malley’s legal costs.
In January Judge Jacqueline Linnane had put the summary judgment application back for mention on 6 March.
How on Wednesday the Circuit Civil Court heard that the money had not been paid to the Louth farmer, though the court did hear that a cheque had been written by Ganley and that is was expected to clear in a matter of days.
The matter was adjourned to a sitting this week, so that the cheque would clear.
