65-year-old caught in ‘one-off’ drug deal

A 65 year-old local man who was arrested in a Garda surveillance operation where they seized e171,00 worth of drugs had sentence adjourned for Judge Leonie Reynolds to obtain an up-to-date medical report on the accused.

Dundalk Circuit Court heard on Friday that Francis McDonagh a father of three of Cocklehill, Blackrock who was present in a wheelchair became involved in what was described as a “one off” venture into the drugs trade. He admitted a charge of possession of drugs for sale or supply.

He was apprehended when Gardai monitored the movements of a co-accused as he travelled from Coolock. They nabbed the pair outside town and seized €e171,000 worth of cannabis resin. They also found e30,000 cash in a boot of a car owned by the accused at his home.

The co-accused was jailed for four years last October at the court. Judge Reynolds remanded McDonagh on bail and put the case in for mention next Friday with a view to a further remand.

A Detective told the court on October 7th 2010 that he monitored the movement of the co-accused who met up with a vehicle driven by the accused near a roundabout. As the Gardai approached there was an attempt to dispose of a black plastic bag.

The accused told that Gardai firstly that he was getting e10 a kilo for his involvement, and later said e50 in total.

He said he knew nothing about the €e30,000 cash found in a follow up search in a car at his home.

Mr. Jonathan Kilfeather SC said the accused was asked to assist by a member of his family. He facilitated that member who was known to the Gardai. He took responsibility for the cash but maintained he had nothing to do with it. He co-operated with the Gardai when apprehended. He had no involvement in the drug trade before or since. He was an elderly man in very poor health and there was no likelihood of him re-offending. He urged the Judge to impose a suspended sentence. The case was adjourned pending an up-to-date medical report
