Dundalk Town Councilor Mark Dearey has taken the Village magazine to court regarding an article about a planning application by Carnbeg Developments in 2007.

Dundalk Town Councilor Mark Dearey has taken the Village magazine to court regarding an article about a planning application by Carnbeg Developments in 2007.

In the Circuit Civil Court, the editor of the Village magazine, Michael Smith said that the story was “incorrect” but he denied that it was defamatory.

The magazine had printed a retraction following the article about the planning application. The original article said that Cllr Dearey had voted in favour of the development.

Cllr Dearey was not a member of the county council at the time of the vote.

Cllr Dearey says that the article was defamatory to him, which the editor of the Village did not accept in the published retraction.

Cllr Dearey’s solicitor, James McGuill, had written to the magazine to have all unsold copies withdrawn. This did not happen.

Mr Dearey said the defendant’s failure to accept that the article was defamatory of him meant the damage to him continued unchecked.

Mr Dearey’s application was adjounred until 4 November to allow Mr Smith to lodge an affidavit.
